Delta 8 and the DEA

DEA’s IFR has expired. Now what?

Now that the DEA’s  IFR (Interim Final Ruling) has expired… NOW WHAT? 

That’s a question we’ve been digging into. 

As advocates in the cannabis industry, we are continuing to monitor any news on DEA’s IFR since it has expired. We will keep you updated once we hear anything worth noting that may affect the sales of Delta 8 or any other legal cannabinoid that we currently sell.   

We truly have no idea which direction this will go since we are hearing many points of view from vendors, industry advocacy groups, and legal counsel.  However, industry groups have already launched a preemptive lawsuit against the DEA.   Historically, this has done well for the cannabis industry to some extent.  This can sometimes be a lengthy process depending on the case. However, the efforts are well worth the investment of time and money.

At this point, only Delta 8 products are questionable at best from a DEA standpoint. We feel confident that any DEA’s IFR ruling should not affect any CBD products in the near future.  However, there are multiple aspects of the hemp industry that is affected by the potential ruling.   In either case, it has been suggested that retailers may have the ability to sell any stock they have on hand in the event the ruling does not go the way we would like.  I expect that we’ll have answers in the near future.
